Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and TVB Apps LLC, a Washington limited liability company doing business as Fourplex ("Fourplex," "we," "us," or "our"), governing your use of getfourplex.com and the Fourplex application (the "Service"). By signing up for or using the Service, you agree to these Terms. If you are agreeing on behalf of an HOA or other organization ("Customer"), you represent that you have authority to bind that organization, and "you" refers to that organization.

Please also review our Privacy Policy, which explains how we handle information.

The Service

Fourplex provides management software for small, self-managed homeowners associations and similar communities. Current features include a board-shared, threaded inbox with drafts and delivery tracking; a calendar with reminders and meeting notices; document storage; meeting coordination; a member directory; records-request and maintenance-request tracking; architectural-review (ARC) workflows; announcements; online voting and elections; HOA dues billing with autopay (card and bank transfer); optional bank connections; an optional AI assistant (Neo); and optional utility submetering. Additional features are released as they become available, and we may add, change, or discontinue features over time.

Shared inbox. Authorized board users can read, draft, address, send, search, archive, and mark community email as spam on the Customer's behalf. Conversation read, starred, archived, spam, and draft state is shared among the Customer's authorized board users rather than private to one board member. Email delivery depends on third-party providers and recipients' mail systems; Fourplex may display delayed, partial, failed, suppressed, bounced, or complaint states and provide retry or editable-resend tools, but does not guarantee delivery to every recipient.

Accounts and authorized users

You must provide accurate information when creating an account and keep it current. You are responsible for activity under your account and for maintaining the security of your sign-in. Each Customer is responsible for the conduct of the board members, residents, and other users it invites ("Authorized Users") and for ensuring they comply with these Terms. Notify us promptly of any unauthorized use.

Subscription, fees, and billing

Fourplex is offered on paid subscription plans priced by community size (graduated platform pricing based on billed unit count), with optional add-ons such as utility submetering billed as a separate line on the same subscription. Current plans and prices are published on our pricing page. Plans may be billed monthly or annually, and fees are charged to the payment method on file at the start of each billing period. Subscriptions renew automatically for successive periods unless cancelled. We may change our prices and plans at any time. Except where a separate written contract with you states otherwise, we will give you advance notice of any price change that affects your existing subscription, and the change will take effect at your next renewal.

Payment processing

HOA dues, recurring utility services, fees, and subscription charges are processed by Stripe, Inc. ("Stripe"). Residents choose which enabled recurring services may use autopay; each selected service may create a separate Stripe charge. When you or your members make a payment, Stripe collects and stores the payment details; Fourplex does not store full card numbers, full bank account numbers, or routing numbers and stores only non-sensitive payment metadata. By making a payment, you also agree to Stripe's Services Agreement. Stripe is certified under PCI DSS Level 1, and Fourplex maintains the corresponding reduced PCI scope.

Bank connections. If you choose to connect a bank account through Stripe Financial Connections — to enable bank (ACH) payments or read-only balance and transaction visibility — you authorize Stripe to access that account's data on our behalf for those purposes. Fourplex does not store your bank login credentials and cannot initiate transfers out of a connected account. You may disconnect a linked account at any time.

Your data

Your HOA's data is yours. We do not claim ownership of the data you enter into Fourplex, and we process it as your service provider as described in our Privacy Policy. You can export your data at any time, and on account closure we make your data available for export before deletion as described in that policy.

AI features (Neo)

If enabled for your community, the Neo assistant uses large language model technology to help you find and summarize information. Your use of Neo is subject to the following:

  • Accuracy and limitations. Outputs generated by Neo ("AI Outputs") are probabilistic and may be incomplete, inaccurate, or outdated. AI Outputs are provided for informational convenience only and do not constitute legal, financial, property-management, or other professional advice. You are solely responsible for verifying AI Outputs against official records before relying on them, and Fourplex is not liable for decisions made in reliance on unverified AI Outputs.
  • No model training on your data. Fourplex does not use your data to train AI models, and we contractually require zero data retention from the AI providers that process Neo requests.
  • Acceptable use. You agree not to use Neo to attempt to access data you are not authorized to see, to circumvent access controls, or to generate unlawful, harmful, or abusive content.

Utility submetering

If your HOA enables utility submetering, Fourplex collects meter readings from a third-party meter provider and calculates per-unit usage charges based on that data and the rates your HOA configures. Meter readings and the resulting calculations may be delayed, incomplete, or inaccurate due to factors outside our control, including meter hardware, the third-party provider's data, or your HOA's configuration.

Where a community also enables flat-rate utility split billing (such as trash), the resident portal includes a Utilities view that displays each unit's computed charge alongside a derivation disclosure — showing the community's total bill amount, the split method the board selected (equal per unit, occupancy, or ownership percentage), and the allocation factor used to arrive at that unit's share. These values are computed at charge-generation time, are final for the billing period in which they were generated, and are displayed in the portal solely for the resident's reference and transparency.

Fourplex helps submeter and bill water charges directly to property owners. Fourplex does not provide tenant billing and is not responsible for any arrangement in which an owner passes water charges through to a tenant or other occupant. If you pass charges through to a tenant, you are solely responsible for ensuring that arrangement complies with all applicable laws and regulations, which vary by jurisdiction.

You are responsible for reviewing your bills. To the fullest extent permitted by law, Fourplex is not liable for any billing inaccuracies arising from submetering, including any resulting late fees, interest, or other charges. You should inspect each bill and promptly report any suspected inaccuracy to us at hello@getfourplex.com so it can be investigated and corrected. While we will work in good faith to correct confirmed errors, you remain ultimately responsible for the amounts billed.

Acceptable use

You agree not to use the Service to:

  • Violate any applicable laws or regulations;
  • Store or transmit unlawful, defamatory, infringing, or harmful content;
  • Infringe the intellectual-property or privacy rights of others;
  • Attempt to gain unauthorized access to any part of the Service or another community's data;
  • Reverse engineer, scrape, or probe the Service except as permitted by law; or
  • Circumvent, overload, or abuse the Service, including through excessive API usage or bulk operations beyond reasonable individual use.

Public community websites. Fourplex provides each association an optional public website. The association is solely responsible for all content it publishes there and must not post content that is unlawful, hateful, harassing, infringing, or otherwise improper. Fourplex may remove or disable such content at its discretion at any time and will notify the association when it does so. The association is responsible for its own compliance with any laws that require it to publish information on a website.

Usage limits and fair use

Fourplex reserves the right to set, change, and enforce reasonable usage limits at any time — for example, on storage, number of members, number of units, emails sent, or API requests. We will publish any applicable limits on our pricing page or in your account settings, and we will give reasonable notice before reducing limits that affect your existing plan. We may make exceptions to published limits at our discretion, including suspending or restricting access to accounts that we reasonably believe are being used abusively, fraudulently, or in violation of these Terms.

Third-party services

The Service relies on third-party providers, including Stripe, Supabase, Resend, Vercel and its AI Gateway, PostHog, Sentry, Cloudflare, and (for submetering) NextCentury. A current list is published on our Subprocessors page. Your use of features that depend on these providers may be subject to their terms, and we are not responsible for the availability, accuracy, or practices of third-party services. Our processing of community data on your behalf is governed by our Data Processing Agreement.

Intellectual property and feedback

The Service, including its software, design, and content (excluding your data), is owned by Fourplex and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. If you provide feedback or suggestions about the Service, you grant Fourplex a perpetual, royalty-free, worldwide license to use that feedback without obligation or compensation.

Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FOURPLEX DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUTS OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE WILL BE ACCURATE OR COMPLETE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FOURPLEX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. FOURPLEX'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Fourplex from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms or applicable law, or content you or your Authorized Users submit through the Service.

Suspension and termination

We may suspend or terminate your access to the Service for non-payment, violation of these Terms, illegal activity, or a security threat. Where practical, we will provide notice, but we may act immediately to address urgent risks. You may stop using the Service at any time.

Cancellation

You may cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial periods. After cancellation, your data is available for export and is then deleted as described in our Privacy Policy.

Force majeure

Fourplex is not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, acts of government, pandemics, internet or power outages, or failures of third-party infrastructure or payment processors.

Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, the state and federal courts located in King County, Washington have exclusive jurisdiction over any matter not subject to arbitration.

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully — it affects your legal rights.

Informal resolution first. Before starting an arbitration, you agree to contact us at hello@getfourplex.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. Except as provided below, any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, before a single arbitrator. The arbitration will take place in King County, Washington, or by remote proceeding, and judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. Disputes will be arbitrated only on an individual basis. You and Fourplex waive any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims.

Exceptions. This section does not require arbitration of: (a) claims that qualify for small-claims court; or (b) requests for emergency or injunctive relief to protect intellectual-property or confidential information, which may be brought in the courts identified above.

30-day opt-out. You may opt out of this arbitration agreement by emailing hello@getfourplex.com within 30 days of first accepting these Terms and stating your intent to opt out. If you opt out, the "Governing law" section's court-jurisdiction provisions will govern your disputes.

Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, notify users through the Service or by email before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.

Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy and any plan terms referenced on our pricing page, are the entire agreement between you and Fourplex regarding the Service.
